Important Elder Law Numbers: Updated for February 1, 2014
* DHS amended OAR 461-160-0620(3)(c)(C) effective February 1, 2014, to increase the amount of the income deduction for a Medicaid recipient who gets in-home services. The need standard for a person who receives in-home services is now the OSIPM maintenance standard ($721 per month in 2014) plus $500, which equals $1,221 per month. Prior to February 1, the figure was $721 per month.
This rule change will affect the calculation of the pay-in or liability payment that a recipient of in-home services may be required to make to DHS. For married recipients, the rule change will affect the amount of income that is available to pay a community spouse income allowance.
