EXECUTIVE DIRECTOR, PUBLIC DEFENDER OFFICE – Public Defender Of Marion County, Inc. (PDMC), located in Salem, Oregon, is seeking an experienced criminal trial lawyer/administrator to fill the position of Executive Director. PDMC is a private, non-profit corporation that contracts with the State of Oregon through the Public Defense Services Commission to provide quality representation to persons charged with crimes in Marion County Circuit Court. The charges range from misdemeanor probation violations to non-capital murder cases. The office contracts for approximately 2500 cases per year. It is one of two entities providing such services in the jurisdiction. It does not contract to represent youths in Juvenile Court, nor does it represent individuals in civil commitment proceedings. The office currently consists of ten deputy public defenders, three investigators, three legal assistants and three office staff, which includes an Office Manager. At a minimum, applicants must be active members of the Oregon State Bar, have at least five years experience as a criminal defense attorney, be qualified to try murder cases under the PDSC Certification Requirements for Public Defenders, and have some administrative or managerial experience. Preference will be given to those applicants who have worked in a public defender office, especially if it has been in an administrative or managerial capacity. A partial job description includes: Appear in Marion County Circuit Court on behalf of persons accused of crimes, including arraignments, motion practice, trials and sentencings; train, mentor and supervise less experienced attorneys; supervise senior office personnel. Review office financial and budget reports monthly and report on them to the Board of Trustees; review and approve all purchases and other office expenditures, which includes signing all checks; contracting for services and major purchases necessary to the continued growth and smooth operation of the office; review payroll records bi-monthly; monitor case loads for the office and individual lawyers to assure that ethical caseload standards are adhered to; hire all personnel; perform regular employee evaluations of senior staff and attorneys; review and update the office employee manual regularly; assure that office procedures and job descriptions are written down and updated regularly; Oversee the preparation of monthly financial and caseload reports for presentation to the Board of Trustees; keep the Board advised of significant developments within the office or within the broader public safety community that impact the office or its reputation; Oversee and participate in Annual Reports and Annual Audits as required by contract; negotiate or renegotiate property leases; contract for and maintain all necessary insurance plans, including Board liability, business liability, and malpractice insurance. Liaison with the Marion County bench, bar, and criminal justice community; represent PDMC, public defense providers and criminal defense on various local and statewide committees; participate in work groups and pilot projects dealing with various aspects of public defense or criminal law and procedure; testify before the legislature as needed on behalf of specific bills bearing upon criminal law or public defense, and on behalf of funding requests for public defense; appear as a spokesperson for the office and for public defense in general at various community functions; Negotiate a bi-annual contract with the Oregon Public Defense Services Commission to fund PDMC sufficiently to meet current costs and allow for measured growth and adequate compensation for the employees; administer a retirement program for all employees; annually negotiate an adequate and cost- effective health insurance contract.
