C. FREDRICK BURT
On Dec. 5, 2011, the disciplinary board approved a stipulation for discipline reprimanding Salem attorney C. Fredrick Burt for violating RPC 8.1(a)(2) (knowing failure to respond to lawful demands for information from a disciplinary authority).
In January 2011, the bar received a complaint that Burt had ignored requests from a former client for a copy of his file. The bar’s disciplinary counsel’s office asked Burt several times to respond to the complaint, but Burt failed to do so. Disciplinary counsel therefore assigned the matter to the Local Professional Responsibility Committee (LPRC) for investigation.
Burt cooperated with the LPRC’s investigation. The LPRC found no evidence that the client had ever requested his file from Burt before filing his bar complaint and no probable cause to assert that Burt had failed to provide the client’s file promptly upon request. However, by failing to respond to disciplinary counsel’s inquiries, Burt violated RPC 8.1(a)(2).
Burt was previously admonished in 2007 for a similar failure to respond to inquiries from the disciplinary counsel’s office.

Notice of Reinstatement Application
The following attorneys have filed an application for reinstatement as an active member of the Oregon State Bar pursuant to Rule of Procedure (BR) 8.1:
Tara M. Hendison of Portland, #980635. Tara Hendison transferred to inactive status in 2005 because her employment with the Allen Trust Company did not involve the practice of law. She currently is a senior trust officer with Allen Trust and has no plans to return to the active practice of law following her reinstatement.
Lisette M. Spencer of Springfield, #963398. Pursuant to a 2010 stipulation for discipline, Lisette Spencer was suspended from the practice of law for 90 days effective Sep. 1, 2010. In re Spencer, 24 DB Rptr. 209 (2010). She did not seek reinstatement at the end of the 90 days. Upon reinstatement, she intends to practice law in the Eugene-Springfield area.
James M. Pippin of Portland, #711354. In 2005, James Pippin transferred his bar membership to inactive status after working as a personal injury attorney in the Portland area for many years. While inactive, he has been involved in the development of recreation properties in central Oregon. He plans to return to the active practice of law in Portland following his reinstatement.
The Rules of Procedure require the Board of Governors to conduct an investigation of BR 8.1 reinstatement applications to determine whether applicants possess the good moral character and general fitness to practice law and whether the resumption of the practice of law in this state by the applicants will not be detrimental to the administration of justice or the public interest.
