Equal Opportunity Employer 38 OREGON STATE BAR BULLETIN • AUGUST/SEPTEMBER 2016 Report Unclaimed or Abandoned Funds in October It’s time to take a look at your law- yer trust account and determine whether any unclaimed or abandoned client funds should be forwarded to the bar in October. Funds are deemed unclaimed or aban- doned if the owner has not accepted pay- ment of the funds, corresponded in writ- ing about the funds or otherwise indicated interest in the funds within two years af- ter the funds are payable or distributable to the owner. Funds deemed unclaimed or abandoned as of June 30 of each year are to be reported during the month of October of that same year, although ear- lier reporting may be allowed upon writ- ten request. Unclaimed or abandoned funds held in lawyer trust accounts must be report- ed to the Oregon Department of State Lands, but paid over to the Oregon State Bar with a copy of the DSL report. Note that if the owner’s last known address is in a different state, those funds must be reported and sent to that state. Unclaimed or abandoned client funds are appropriated to the OSB Legal Ser- vices Program to be allocated to organi- zations providing civil legal aid to low- income Oregonians. Questions about forwarding aban- doned funds can be addressed to Judith Baker at (503) 431-6323 or jbaker@osbar. org. New MCLE Reporting Categories Created As of Sept. 1, the Oregon Supreme Court amended the MCLE Rules/Regula- tions to create new reporting categories. These amendments increase the methods members can use to earn MCLE credits. Under the new MCLE Rules/Regulations, there are three categories, which are out- lined at www.osbar.org/mcle. These categories do not affect the type of credit earned, but rather how credits are reported. The amended MCLE Rules/ Regulations will help the bar shift to an online reporting system, which is ex- pected to be implemented in the spring of 2017. For full details, visit www.osbar.org/ mcle. House of Delegates Meetings Scheduled This Fall The OSB House of Delegates will hold its annual meeting Nov. 4 at the OSB Center in Tigard. There are two im- portant dates before the meeting that bar members should be aware of. On Oct. 14, the agenda will be dis- tributed to members of the House of Del- egates. The agenda will also be published online at www.osbar.org/leadership/hod/ meeting.html. Then, Oct. 18-20, the second round of regional meetings will be held. At these meetings the delegates will review the proposed resolutions and determine if they want to take a position at the full House of Delegates meeting in October.
